Seek help if your workers’ compensation claim is denied

On Behalf of | May 31, 2019 | Workers' Compensation

Workers’ compensation is a type of insurance coverage that the majority of employers are required to purchase for their employees. There are exceptions, but in typical jobs, employees will be covered in the case that they’re hurt on the job.

In Florida, the Division of Workers’ Compensation is in charge of making sure that employees get the benefits that they are entitled to through workers’ compensation.

What benefits do employees get if they’re hurt on the job?

No two accidents are going to be the same, but the benefits you’re entitled to will be similar. For example, you will be entitled to compensation for the time when you couldn’t work if it spans an approved length of time through the insurer. You’ll also have your medical care covered and may be entitled to additional benefits, like training for a different position.

Are all accidents compensable?

Not all accidents are compensable, but the majority are. Some that may not be covered include accidents on the way to or home from work, self-inflicted injuries and injuries that happen at work when off the clock (although this is sometimes still covered).

If you are hurt on the job, it’s your right to file a claim with the workers’ compensation carrier. They will let you know if they plan to approve or deny your claim. If it is denied, then you have the right to appeal the denial, including providing more information on why you believe you should have your claim approved.

Your attorney can help you if you believe your claim has been unfairly denied. Sometimes, it just takes more evidence to support your claim and get it approved.
