What can you do if you’re denied workers’ compensation?

On Behalf of | Nov 28, 2018 | Workers' Compensation

Even if you have suffered an on-the-job injury, it doesn’t necessarily mean you’ll immediately receive workers’ compensation benefits. In fact, even if you’re due benefits, something could get in the way that slows you down.

Here are some steps to take if you’re denied workers’ compensation:

  • Contact the insurance company: Do so with the idea of finding out the reason for the denial and if there is anything you can quickly do to make things right (such as providing a missing document).
  • Ask the insurance company to revisit the denial: For example, if you share more documentation regarding the accident and your injuries, the insurance company may take a second look at your claim.
  • File a formal appeal: If a discussion with your insurance company goes nowhere, it’s time to file a formal appeal. The process should be outlined in your denial letter.
  • Collect evidence: Provide as much information as possible to back up your claim. Anything you share has the potential of working in your favor, thus allowing you to receive workers’ compensation benefits in the future.

Appealing a workers’ compensation claim denial is a complicated process full of many challenges. Even if you think you’ll come out on top, you never know how the insurance company will fight back.

As you review your workers’ compensation denial letter, make note of the things you can do to improve your chances of a future approval. From there, follow the process outlined by the company and do whatever it takes to protect your legal rights. You’ve been injured on the job and you shouldn’t have to suffer more than you already are.
